Debt collection, debt repayment and bailiff claim form
Debt collection agencies, bailiff companies and debt repayment agencies must be licensed and meet certain requirements. These businesses must provide a security held in trust. If a valid claim occurs we are able to draw upon this fund. The security is held for the entire time these businesses are licensed with us and two years after.

If you made an arrangement with a debt repayment agent, or paid money to a collection agency, or bailiff and they have failed to pass along the funds to your creditor you can complete our claim form and provide supporting evidence.
If you are a creditor who has failed to receive the funds from a collection agency, or bailiff you can also complete our form and provide us with supporting evidence.
Eligible claims made by a debtor against a debt collection agency or bailiff are settled on a net basis.
Eligible claims made by a debtor, against a debt repayment agency are settled on a gross basis.
The amount you paid to the debt repayment agent, debt collection agency, or bailiff, that was not distributed to your creditors is the amount that you would enter as your claim. Commission paid is not claimable.
You have up to two years to make a claim from the date of the failure, or default. Because of this, claims are typically not settled until after the two-year period. If the number of claims received are higher than the amount available, then the claims will all be pro-rated.
A debt repayment agent, debt collection agent or bailiff company holds a minimum security of $10,000 and a maximum security of $50,000.
Eligible claims made by creditors against a collection agency, or bailiff are settled on a net basis.
The eligible claim amount is the amount collected by the collection agency, or bailiff that is not passed along to the initial creditor.

To submit a claim, fill out the claim form and provide all the following supporting documentation:
- Proof money was paid to the debt collection agent, debt repayment agent, or bailiff
- Written statement laying out the payments you made to the collection agent, or bailiff
- Letter from your creditors indicating what payments have been made, and what is outstanding
- Any other letters or communications you have had with the debt repayment agent, collection agent or bailiff, including any remittance notices
- Copy of the contract or agreement
- If the claim is against a debt repayment agent, provide a listing of all the creditors involved.
If you are unable to provide certain supporting documentation, please include an explanation as to why not.
It’s important to know that we will share your claim, along with all the supporting documents with the licensed business who you are making a claim against. This gives both parties equal opportunities to share their position and evidence, which will allow us to adjudicate the claim.
Once a decision is reached you, along with the licensed business will be notified in writing.
