Contracts for services that are ongoing and physical in nature are known as continuing services contracts. They include dance lessons, personal training, weight loss, self-defence, gym and travel club memberships. By law, you have cancellation rights with these types of contracts.

You have 10 days from the day you receive a copy of your contract to cancel for any reason.
To cancel your contract, complete our cancellation form and send it directly to the business in a way that allows you to get proof of delivery (such as mail or email). Keep track of your communication and follow up with the business to confirm they received it. The law gives the business 15 days to respond.

My situation has changed. Can I cancel?
The law gives you the right to cancel if there is a material change in your circumstances. For example, if you moved more than 30 km from the facility, or you are mentally or physically unable to participate in the activity you signed up for.
To cancel your contract for these reasons, fill out our cancellation form and send it to the business. Attach proof of your material change. This may be proof of your new address or a note from a medical doctor or nurse practitioner showing that you can’t continue. Send this all to the business in a way that allows you to get proof of delivery, like mail or email.
Keep track of your communication and follow up with the business to confirm they received it. The law gives the business 15 days to respond.
In these situations, by law, the business can keep up to 30% of the amount owed back to you to cover their costs.

The gym or business has changed the services offered. Can I cancel?
If the business has changed the services that were originally offered, it is considered a material change by the supplier. For example, if the business has closed or moved, or an amenity like a pool is no longer available.
To cancel your contract, fill out our cancellation form and send it to the business. Send the form (and your proof of the material change) to the business in a way that allows you to prove delivery, like registered mail or email.
