Consumer Protection BC Warns Payday Lending Consumers Print E-mail
{February 24, 2012} VICTORIA, BC - Consumer Protection BC is alerting consumers that NCA National Cash Advance (Canada) ULC, a payday lender, will be closing its offices by the end of the day today. National Cash Advance has six offices in Abbotsford, Burnaby, Maple Ridge, Mission and Surrey.


Consumer Protection BC is pursuing an investigation into National Cash Advance’s alleged contravention of BC’s payday lending law. While we cannot speak to the details of open investigations, we can share that the company has voluntarily surrendered their payday lending licenses. They have also made a commitment in writing that any customer adversely affected by their actions will be made whole in a prompt and transparent fashion.

We want to take this opportunity to remind consumers of their rights when entering into a payday loan in BC:

  1. Payday lenders can’t use unfair practices such as collecting a repayment from an employer, getting unrestricted access to your bank account, and requiring repayment dates before you receive your paycheque or income.
  2. You cannot be charged more than 23% of the amount you borrowed - no matter what.
  3. You have the right to change your mind and cancel the loan by the end of the following business day for any reason, without paying any charges.
  4. If you are getting your 3rd loan in 2 months and you get paid every 2 weeks, you can pay it back over 3 pay periods (two pay periods if paid monthly).
  5. The payday loan agreement must list all of the charges, terms and conditions of the loan.
  6. Payday lenders can’t issue you more than one loan at the same time.
